1. ACCEPTANCE_OF_TERMS

By accessing or using the services provided by binaryfoundrylab, located at Store Kongensgade 40, 1264 København K, Danmark ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. SCOPE_OF_SERVICES

binaryfoundrylab provides creative digital services including but not limited to brand identity design, web development, motion graphics, social media content creation, print production, UI/UX research, illustration, 3D visualization, and content strategy. Specific deliverables, timelines, and pricing are defined in individual project agreements.

3. PROJECT_ENGAGEMENT_PROTOCOL

All projects begin with a discovery phase where requirements are documented and agreed upon. Changes to project scope after agreement may result in additional charges and timeline adjustments. We reserve the right to refuse work that conflicts with our ethical guidelines.

4. INTELLECTUAL_PROPERTY_RIGHTS

Upon full payment, binaryfoundrylab grants the client a perpetual, non-exclusive license to use all deliverables created specifically for the project. The Company retains the right to display work in portfolios and marketing materials unless explicitly prohibited in the project agreement.

5. PAYMENT_TERMS

Invoices are payable within 30 days of issuance unless otherwise specified in the project agreement. A 50% deposit is required before project commencement. Late payments may incur a 2% monthly interest charge. All prices are in Euros (EUR) unless otherwise stated.

6. CONFIDENTIALITY_OBLIGATIONS

Both parties agree to maintain the confidentiality of proprietary information shared during the course of the engagement. This obligation survives the termination of the project agreement for a period of 36 months.

7. LIMITATION_OF_LIABILITY

binaryfoundrylab's total liability for any claims arising from our services shall not exceed the total fees paid by the client for the specific project giving rise to the claim. We are not liable for indirect, incidental, or consequential damages.

8. TERMINATION_CLAUSES

Either party may terminate a project agreement with 14 days written notice. Upon termination, the client is responsible for payment of all work completed up to the termination date. Work products delivered prior to termination remain subject to the intellectual property terms outlined in Section 4.

9. GOVERNING_JURISDICTION

These Terms of Service are governed by and construed in accordance with Danish law. Any disputes shall be subject to the exclusive jurisdiction of the courts of Copenhagen, Denmark.

10. MODIFICATIONS_TO_TERMS

binaryfoundrylab reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Continued use of our services constitutes acceptance of modified terms.

binaryfoundrylab offers refunds under the following circumstances:

• Services not delivered as specified in the project agreement
• Significant deviation from agreed-upon deliverables without prior authorization
• Project cancellation before work commencement (full refund minus administrative fees)
• Technical issues preventing service delivery that cannot be resolved

2. PARTIAL_REFUND_CONDITIONS

If a project is cancelled after work has begun, a partial refund may be issued based on the percentage of work completed. The refund amount will be calculated as follows:

• Cancellation within first 25% of timeline: 75% refund of remaining balance
• Cancellation between 25-50% of timeline: 50% refund of remaining balance
• Cancellation between 50-75% of timeline: 25% refund of remaining balance
• Cancellation after 75% of timeline: No refund (work near completion)

3. NON_REFUNDABLE_ITEMS

The following are not eligible for refund:

• Third-party costs already incurred (stock photos, fonts, printing, etc.)
• Work completed and approved during the project milestone
• Rush fees or expedited service charges
• Consulting hours already delivered

4. REFUND_REQUEST_PROCEDURE

To request a refund, submit a written request to [email protected] within 14 days of the service delivery or project completion. Include your project reference number, invoice number, and detailed reason for the refund request.

5. REFUND_PROCESSING_TIMELINE

Approved refunds will be processed within 14 business days. Refunds are issued to the original payment method. Please allow additional time for your financial institution to process the refund.

6. DISPUTE_RESOLUTION
